Dispute resolution is the process of resolving disputes between parties.

Methods of dispute resolution include:

One could theoretically include violence or even war as part of this spectrum, but dispute resolution practitioners do not usually do so; violence rarely ends disputes effectively, and indeed, often only escalates them. Some individuals, notably Joseph Stalin, have stated that all problems emanate from man, and absent man, no problems ensue. Hence, violence could theoretically end disputes, but alongside it, life.

Dispute resolution processes fall into two major types:

  1. Adjudicative processes, such as litigation or arbitration, in which a judge, jury or arbitrator determines the outcome.
  2. Consensual processes, such as collaborative law, mediation, conciliation, or negotiation, in which the parties attempt to reach agreement.

Not all disputes, even those in which skilled intervention occurs, end in resolution. Such intractable disputes form a special area in dispute resolution studies.

A. Also sometimes called non-binding arbitration. It's a process where an expert -- either legal or based on the subject matter -- listens to the evidence and renders a professional opinion on the likely outcome. The neutral then often gives a recommendation on a settlement. The parties can then follow that recommendation, or not. But it has no binding effect as a matter of law. Unlike binding arbitration, which is similar in process, different in outcome.

A. Alternate Dispute Resolution (ADR) is resolving conflicts without going to court. Arbitration is one method, there are others. Arbitration is where each side presents their case to the Arbitrator, who then makes a final decision. Arbitration may be "binding" as in its final and the parties must accept it, or "non-binding" which means they are free to go to court if they disagree with the result. Arbitration may be voluntary, or it may be compelled by the underlying contract, or ordered by a court before it makes a final decision. The Arbitrator should ideally be a neutral third party, but "it ain't necessarily so."

In concern of ADR (Alternative Dispute Resolution) which cases are more relevant to this type of service?
Q. For instance you wouldn't see a murder case there, nor theft assault or fraud, but what type of cases would be referred there, there s Divorce, child custody, what else is there to see it as valued system in comparison to court trials? Thanks so far Wolfe-Steve!

A. Virtually any civil dispute can be submitted to ADR -- a contract claim, a discrimination claim, you name it, it can be mediated.
