Arbitration, a form of alternative dispute resolution (ADR), is a legal technique for the resolution of disputes outside the courts, wherein the parties to a dispute refer it to one or more persons (the "arbitrators", "arbiters" or "arbitral tribunal"), by whose decision (the "award") they agree to be bound. It is a settlement technique in which a third party reviews the case and imposes a decision that is legally binding for both sides. Other forms of ADR include mediation (a form of settlement negotiation facilitated by a neutral third party) and non-binding resolution by experts. It is more helpful, however, simply to classify arbitration as a form of binding dispute resolution, equivalent to litigation in the courts, and entirely distinct from the other forms of dispute resolution, such as negotiation, mediation, or determinations by experts, which are usually non-binding. Arbitration is most commonly used for the resolution of commercial disputes, particularly in the context of international commercial transactions. The use of arbitration is far more controversial in consumer and employment matters, where arbitration is not voluntary but is instead imposed on consumers or employees through fine-print contracts, denying individuals of their right to access the courts. Arbitration can be either voluntary or mandatory and can be either binding or non-binding. Non-binding arbitration is, on the surface, similar to mediation. However, the principal distinction is that whereas a mediator will try to help the parties find a middle ground on which to compromise, the (non-binding) arbitrator remains totally removed from the settlement process and will only give a determination of liability and, if appropriate, an indication of the quantum of damages payable. GNU Free Documentation License Midland credit management is threatening me with arbitration. What does this mean? Q. I am trying to get my credit good by working through my debts one bill at a time. One of my accounts got sent ot Midland Credit Management. I spoke with one of the representatives trying to set up a payment schedule. She would not work with me on a 12 month plan. She would only go for 5 months on a higher amount. She then grew upset and pushy and informed me that they would be taking me to arbitration. I then tried to call the company back just to get a mailing address to send them a letter request verification that I have a legal obligation to them. If they are pushing for it because there was an arbitration clause in your original agreement, you do have a legal right to refuse arbitration. If it is in your original agreement - some of what it violates: House Resolution 5162 which amends Title 15 USC 1601 of the Consumer Credit Protection Act the Federal Arbitration Act (S. 192) H.R. 1054 and 3607 that amend the Truth in Lending Act make pre-dispute mandatory arbitration void and unenforceable Plus, there is "plenty" of case law to back that up. Why is it so important if a player accepts/denies arbitration. ? Q. How does it also effect teams that sign such a player, doesn't it effect that team's draft selection. Asked by Alsnowman - Fri Jan 30 13:10:00 2009 - - 4 Answers - 0 Comments A. Baseball players are members of a union, which helps them negotiate the terms of their employment with the teams. In that way, it is no different than other unions (steel, auto workers, etc.). Unions and employers in that industry sign a Collective Bargaining Agreement (CBA), and it represents the terms of the employment between the union members and the employers. In MLB, the players are the union members and the teams are the employers. The baseball CBA provides arbitration for two groups: 1. Free agents, which are the players that are not currently controlled by a particular team; and 2. Players with between three and six years service time. The idea of arbitration is supposed to be one of efficiency. It often resolves… [cont.] Answered by chapelheel66 - Fri Jan 30 13:46:05 2009 If a player does not accept arbitration, can he still sign with his former team?
Q. For example Pedro Feliz did not accept the arbitration offer. Can he still sign with the Giants or not, etc. Asked by Giants Fan! - Sat Dec 8 01:09:16 2007 - - 5 Answers - 0 Comments A. Yes he can, and actually they made it easier when they signed the new collective bargaining agreement. Before teams/players had to wait until mid may to sign with their former team if they declined arbitration. now even if they decline it they can sign at anytime. So yes Pedro Feliz can still be a Giant next season, great glove just wish he would occasionally take a walk.
