A. Alternative Dispute Resolution ("ADR") refers to any means of settling disputes outside of the courtroom. ADR typically includes arbitration, mediation, early neutral evaluation, and conciliation. As burgeoning court queues, rising costs of litigation, and time delays continue to plague litigants, more states have begun experimenting with ADR programs. Some of these programs are voluntary; others are mandatory.

A. The three main ADR methods are mediation, non-binding arbitration (also known as neutral evaluation) and binding arbitration. Though often confused, they are all entirely different. Mediation is a process of guided negotiation. The mediator acts as a combination referee and goalie, helping the parties to separate their actual objectives from emotional entanglements. The goal of mediation is to allow the parties to craft a mutual settlement that addresses their concerns and is a win-win for both/all parties. Binding arbitration is the opposite end of the spectrum. It's effectively an informal trial, where the parties present witnesses and evidence, and the arbiter (often an attorney or retired judge) makes a decision about who wins. The… [cont.]

Q. What is neutral assessment, as a method of dispute resolution?
Asked by rdfdr - Thu Mar 22 19:55:51 2007 - - 4 Answers - 0 Comments
A. Also sometimes called non-binding arbitration. It's a process where an expert -- either legal or based on the subject matter -- listens to the evidence and renders a professional opinion on the likely outcome. The neutral then often gives a recommendation on a settlement. The parties can then follow that recommendation, or not. But it has no binding effect as a matter of law. Unlike binding arbitration, which is similar in process, different in outcome.

A. Disadvantage: you may not get the decision you want yet have to abide by it, that is to say there may be an agreement to accept whatever decision is made - and this maybe arbitrary. Advantage: it puts an end to disputes which drag on getting more embroiled with other issues.

Special Education Dispute Resolution?
Q. Hi I am getting ready to go to a dispute resolution meeting for my child. Has anyone ever attend such a meeting? Can you give me details of what will happen at this meeting? Also, did you prevail? Did the school system go with what you wanted or did you end up in Due Process?

A. Dispute resolution is rarely successful in my experience. Many parents tend to opt out of it because it is rarely useful. In my expeirnece these situations end up in Due Process. The only way it works if if both parities are willing to give a little at least and that is rarely possible.. if a compromise was attainable I think it would of often been reached before this step in the process. Good luck!

A. I answered your other question and I don't know why you are having such trouble with this. It's all available with a simple google search. Delta Air Lines and the pilots union jointly requested federal mediation for contract negotiations in November of 2000. If you do a search for National Mediation Board and Air Line Pilots Association, you come up with results such as this: Then you can do sub-searches for terms such as "Arbitration, conciliation and mediation" simply by clicking on visible key words which will lead to even more useful results. If you go to the National Mediation Board website and type "Delta" in the search box, you will bring up all the determinations, opinions and rulings that involved Delta.
